These Terms of Use ("Terms") govern your access to and use of the HaZeyBot Discord bot (the "Bot"), the website located at www.hazeybot.com (the "Website"), and the associated web dashboard (the "Dashboard") (collectively, the "Service"). The Service is operated as a personal project ("we," "us," "our," or "HaZeyBot").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Please also review our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

1. Description of Service

HaZeyBot is an all-in-one server management bot for Discord. It provides moderation and automoderation tools, economy and games, leveling systems, and utility features such as tickets, reaction roles, welcome messages, and logging. These features are configurable through the Dashboard.

We may add, modify, or remove features at any time without prior notice. We reserve the right to discontinue the Service entirely or in part.

2. Eligibility and Accounts

  • You must be at least 13 years old to use the Service, in compliance with Discord's Terms of Service.

  • You must comply with Discord's Terms of Service and Community Guidelines at all times.

  • To access the Dashboard, you must authenticate using Discord OAuth2. You are responsible for maintaining the security of your Discord account and for all activity that occurs under your account.

  • You may manage multiple Discord servers through the Dashboard if you have the necessary permissions (e.g., MANAGE_GUILD, ADMINISTRATOR, or server ownership) on those servers.

  • We do not provide a mechanism to delete your Dashboard account. If you wish to stop using the Service, simply cease using it and, if desired, request deletion of your data as described in our Privacy Policy.

3. Dashboard and Server Configuration

  • The Dashboard allows authorized users to configure per-server settings for all features, enable or disable individual plugins, and view the current premium plan for a server.

  • Access to a server's settings is based on your Discord permissions (server owner, administrator, or MANAGE_GUILD). You are responsible for ensuring that only trusted individuals are granted such permissions.

  • You acknowledge that any configuration changes you make may affect your server and its members. You are solely responsible for the consequences of your configurations.

  • You may not transfer Dashboard access or server ownership to another user through our Service; such changes must be handled within Discord itself.

4. Bot Functionality and Permissions

The Bot requires certain Discord permissions to perform its functions. These may include, but are not limited to:

  • Manage Roles – for join roles, mute role, reaction roles, level-up rewards, birthday roles, and invite-milestone roles.

  • Manage Channels – for tickets, custom voice channels, and channel lock/unlock.

  • Kick/Ban Members – for moderation commands and blacklist auto-kick.

  • Moderate Members – for timeout commands.

  • Manage Messages – for bulk deletion and ticket pinning.

  • Move Members – for custom voice channel management.

  • Connect and Speak – for radio streaming.

The Bot does not require the Administrator permission.

The Bot may read message content for moderation purposes but does not store general message content. However, direct messages sent to the Bot (e.g., for the support inbox) are stored. See our Privacy Policy for details.

You acknowledge that the Bot's actions are based on the configurations you set and the commands you or your members invoke. We are not responsible for the consequences of those actions.

5. User Conduct and Acceptable Use Policy

You agree not to use the Service for any unlawful or prohibited purpose. Specifically, you agree not to:

  • Use the Service for any illegal activity or to promote illegal content.

  • Harass, abuse, threaten, or defraud other users.

  • Send spam or unsolicited messages through the Bot.

  • Exploit bugs, glitches, or vulnerabilities of the Service.

  • Reverse engineer, decompile, or disassemble any part of the Service.

  • Scrape, crawl, or otherwise extract data from the Website or Dashboard without our express written permission.

  • Resell, sublicense, or otherwise commercialize access to the Service without our permission.

  • Engage in scams, phishing, or other deceptive practices.

  • Attempt to circumvent any security or access controls.

  • Use the Service in servers that contain or promote illegal content (e.g., child sexual abuse material, terrorism, hate speech). We reserve the right to refuse service to any server that we determine, in our sole discretion, contains such material.

Server Owner Responsibility: You are responsible for the actions of your server members and any staff members you grant Dashboard access to. If a member or staff member violates these Terms through your server, you may be held accountable.

Acceptable Use Policy: The above restrictions constitute our Acceptable Use Policy. Violation may result in termination of your access to the Service without notice.

6. Data Collection and Use

We collect and process data as described in our Privacy Policy. By using the Service, you consent to such collection and processing. Key points include:

  • We store Discord server IDs, names, channel IDs, user IDs, usernames, avatars, message IDs, role IDs, and your custom settings.

  • We store your Discord OAuth access and refresh tokens to call Discord's API on your behalf.

  • We read IP addresses transiently for rate limiting and language detection but do not persist them.

  • We do not use cookies or analytics tracking on the Website or Dashboard.

  • Data is retained until you request deletion via a ticket or email.

7. Payments and Premium Features

Some features are available only through a paid premium plan. Payment is processed by Stripe or PayPal.

  • Pricing: The set of features included in the premium plan is determined by us and may change over time.

  • No Refunds: All payments are final. We do not offer refunds, including for partial use or cancellation.

  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

  • Cancellation: You may cancel your subscription at any time. Upon cancellation, the associated Discord server will lose access to premium features at the end of the current billing period. No prorated refunds are provided.

  • No Free Trials: We do not offer free trials for premium features.

8. Intellectual Property

All content, code, design, and functionality of the Service are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written consent.

You retain ownership of any data you provide or that is generated through your use of the Service, subject to the license you grant us to operate the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

11. Indemnification

You agree to indemnify, defend, and hold harmless HaZeyBot and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your access to the Service, in whole or in part, at any time, with or without cause, and with or without notice. You may stop using the Service at any time.

Upon termination, your right to use the Service ceases immediately. Data retention after termination is governed by our Privacy Policy.

13. Modifications to Terms and Service

We may update these Terms from time to time. The "Last Updated" date at the top of this page will indicate when changes were made. We will not provide individual notifications; instead, the updated Terms will be posted on the Website with the new date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

We may also modify the Service itself (add, remove, or change features) at any time without notice.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA). The arbitration shall take place in London, United Kingdom, and be conducted in English. Each party shall bear its own costs, and the arbitrator's award shall be final and binding.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from the courts of England and Wales to protect its intellectual property or confidential information.

15. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

  • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.

  • Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, network failures, or third-party service interruptions.

  • No Third-Party Beneficiaries: These Terms do not create any rights for any third parties.

  • Language: These Terms are provided in English only.
